AFlyCloud Terms of Service

1. Introduction

Welcome to AFlyCloud's services. Our cloud server and dedicated server services are subject to these Terms of Service (hereinafter referred to as the "Terms"). By using our services, you agree to comply with these Terms. Please read them carefully.

2. Service Description

We provide diverse cloud server (VPS) and dedicated server solutions suitable for commercial and personal use. We prioritize high performance, reliability, and security.

3. Usage Policy

  1. Compliance: Users must adhere to all relevant laws and regulations.
  2. Prohibited Activities: Illegal activities, malware distribution, network attacks, spam transmission, or any behavior that may damage AFlyCloud's reputation are strictly prohibited.
  3. Content Restrictions: Our services may not be used for storing, backing up, or distributing copyrighted content without proper licensing.
  4. Server Management: Customers are obligated to set up and manage their servers in a manner that does not compromise the integrity and availability of third-party networks, servers, and data.
  5. Prohibition of (Distributed) Denial of Service Attacks: The use of servers for (D)DOS attacks or running open mail relays or other systems capable of performing such operations is strictly forbidden.
  6. Content Publication Restrictions: Customers are prohibited from publishing any content that infringes upon third-party rights or violates applicable laws, including but not limited to pornographic or obscene materials, extremist content, content offensive to public order and morals, gambling, materials that may seriously harm the morals of children or adolescents, or materials that infringe upon third-party rights (copyright, name rights, trademark rights, and data protection rights).
  7. Spam Policy: AFlyCloud maintains a zero-tolerance policy regarding the transmission of unsolicited commercial email (UCE) or spam through our network, including sending unauthorized, proactive advertisements to third parties. Customers are prohibited from using or allowing others to use our network for SPAM/UCE transactions. Customers may not host or permit the hosting of websites or information advertised by SPAM/UCE from other networks. Upon receiving notice of suspected violation of the UCE policy, AFlyCloud will promptly initiate an investigation. If a customer is found to be in violation of our SPAM/UCE policy, AFlyCloud will immediately terminate the customer's account and all data without refund.
  8. Prohibition of Cryptocurrency Mining: Running applications used for mining cryptocurrencies, including but not limited to mining, farming, and plotting cryptocurrencies, is prohibited.

AFlyCloud reserves the right to terminate any part of this agreement at its sole discretion. This includes:

  • Violations of the Acceptable Use Policy
  • Intellectual Property Infringement
  • Legal Non-compliance
  • Transmission of High-Risk Content

We retain sole discretion under this agreement. Both parties understand that AFlyCloud is not obligated to monitor or review your content, or any content uploaded or posted by your users, at any time. You are responsible for your content and any resulting liabilities.

4. Account Management

Customers are responsible for maintaining the security of their account information. All activities under the account are attributed to the account holder.

5. Payment Terms

  1. Fees: Must be paid according to the selected service plan.
  2. Late Payments: May result in service interruption or cancellation.
  3. If a customer has a balance on their account, AFlyCloud will automatically use the balance to pay for the latest membership fee.

6. Service Interruptions and Maintenance

We strive to provide continuous service availability; however, interruptions may occur due to maintenance, upgrades, or unforeseen emergencies.

If our products become unavailable due to factors beyond our control, we commit to providing appropriate compensation to users. To be eligible for such compensation, users must ensure that the product remains in normal operating condition. Please note that we are not responsible for compensation omissions if product functionality is impaired due to issues such as overdue payments.

7. Data Backup

Customers are responsible for regular data backups, although we take reasonable steps to protect customer data. Customers should store backups outside of the servers we provide. Customers are obligated to perform a complete data backup before making any changes themselves or commissioning third parties to do so.

8. Disclaimer

We are not liable for indirect, incidental, or consequential damages related to the use or inability to use the service.

9. Refund Policy

  1. AFlyCloud offers a 3-day money-back guarantee. Customers have the right to cancel this contract within three days of its conclusion.
  2. This policy does not cover the cost of any additional packages and applies only to new AFlyCloud customers.
  3. Conditions: No refund will be provided if the server product traffic usage exceeds 3% of the total purchased traffic (up to a maximum of 100GB), or if there is a valid abuse complaint.
  4. Processing Fee: A processing fee will be deducted upon refund, varying according to the transaction circumstances and payment method.
  5. Special Note: To exercise the right of cancellation, customers must notify us through the ticketing system, as long as the customer initiates the cancellation within three days. The time taken by staff to process the ticketing system will not affect this. The refund amount will be credited to the user's account balance. The balance will not be returned to the customer as cash, nor can it be transferred to other account holders. Please note that special promotional products do not support refunds.

10. Late Fees/Additional Fees and Charges

AFlyCloud reserves the right to charge a late fee of 1.5% compound interest per month, or the highest rate permitted by law, whichever is lower, on all invoices not paid by the due date.

11. Final Interpretation Rights

AFlyCloud retains the final interpretation rights of these Terms of Service. If users continue to use AFlyCloud's products after changes to these Terms of Service, it indicates acceptance of the changes to the Terms of Service.

12. Usage Regulations

When using AFlyCloud services, users must comply with the following regulations. Violation of these regulations may result in account closure and service cancellation.

  1. Prohibition of Ordering through Anonymous Network Proxies: Users are not permitted to place orders through anonymous network proxies. We require users to provide a genuine network environment when accessing and using our services.
  2. Multiple Accounts: An individual may own multiple accounts to purchase services or for business separation. However, it is absolutely prohibited for an individual to use multiple accounts to participate in any time-limited or permanent free activities. Discovery of a single person using multiple accounts to obtain free products will be considered a violation.
  3. Communication with Staff: It is prohibited to provide false or misleading information during communication with staff members.
  4. Prohibition of Non-Compliant Behavior: Users should strictly adhere to the provisions of the Terms of Service when using the service. Any non-compliant behavior, such as service abuse or engagement in illegal activities, will result in immediate account closure.

13. Violation Handling

If a customer violates this agreement, we reserve the right - without prior notice - to lock the server and immediately terminate the contract. If we discover illegal activities, we are obligated to require the customer to immediately delete the offending content and have the right to lock the customer's access to their AFlyCloud service or account.
